Order for Possession Service
An order for possession is a court-issued, post-judgment process for recovering possession of real property.
Separate process
Possession enforcement is separate from serving the landlord-tenant complaint and separate from collecting a money judgment.
Service and notice
The court mails a copy and sends the order for service. The serving officer must serve it within 48 hours. The notice period is ordinarily 10 days for residential leases and 15 days for nonresidential leases, calculated from actual service.
Required documents
Submit the issued order, request form, docket information, judgment and issue dates, property address, lease type, and information about any appeal, stay, bankruptcy, reissuance, or known vacancy.
